Details of Hankyung's case revealed

We previously reported that Hankyung of Super Junior started a lawsuit in order to void his contract with SM Entertainment. The written accusation submitted argues that his contract with SME is unfair due to 6 reasons.

First, the accusation argues that SME was the dominant party in signing of the contract and thus it was written in their favor. When the contract was first signed in January 2003, Hankyung was only 17 years old and he did not have sufficient information on the Korean entertainment industry. Two updates made to the contract in February and December of 2007 were also led by SME and Hankyung had no choice but to accept what was offered by SME.

Second, the length of the contract is 13 years. When the contract was first signed, it was to last for 10 years after the release of Super Junior's first album. After the two updates, the length was extended to 13 years. The contract would last at least until December 2018, when Hankyung would become 34 years old. The contract extends automatically when Hankyung takes break for personal reasons, so the actual length could be much longer than 13 years. The accusation calls this a great invasion of Hankyung's basic human rights.

Third, the contract enforces heavy financial punishment in case of a breach of contract, preventing Hankyung from seeking release. If Hankyung was to breach the contract and move to another entertainment company, he has to compensate SME for 3 times what they invested in him and double what he would have earned for SME during remaining period of the contract. The accusation argues that this makes it impossible for Hankyung to leave SME.

Fourth, the terms on rights and division of responsibilities are unfair towards Hankyung. SME is responsible for vague tasks such as "management of the artist's popularity" and natural tasks such as "notifying the artist of new schedules". On the other hand, Hankyung is to follow SME's decisions without question and without having any rights for adjustment of the contract, making the contract unfair for Hankyung, according to the accusation.

Fifth, the contract made Hankyung overwork. He was forced to pay $10 during his training period for his first offense of being late, being absent, disobedience etc. and $20 per offense after. When he could not be contacted for more than a day, SME was given the right to null their contract. After his debut as a member of Super Junior, if his disobedience resulted in damage of less than $5,000 to SME then he was to compensate $5000; if the damage exceeded that amount then he was required to compensate for whatever the damage he caused. He had no right to present his opinion on any matter, and was forced to follow SME's instructions at all times. The accusation says that Hankyung has lost his confidence due to these reasons.

Due to the fifth reason, Hankyung has not been able to rest for a sufficient amount of time since Super Junior's debut. The accusation argues that he hasn't had a break for last 2 years due to his busy schedule. Because the contract enforces heavy financial punishment and automatic extension of the contract length, he had to continue performing in poor health. According to his representatives he suffers from gastritis and kidney problems resulting from high stress, as well as back pain and exhaustion. He frequently asked for a break due to medical reasons but they were all turned down, the accusation claims.

Sixth, he was not given proper rights regarding profit and products of his performance. Rights to all songs and albums belong to SME, even if the song was written by the artist. Profit division was favored towards SME; in case of albums, Super Junior received 2% of the revenue only if the album sold more than 50,000 copies, for digital sales they received 10% of the net profit; for revenue from overseas they were given 60% of net profit. Album sales meant nothing to the artists as 2% of the revenue was divided among 13 members. Digital sales and foreign income were given to artists only when profit was made, allowing SME free from risk of losing money, according to the accusation.

The written accusation against SME argues that due to these 6 reasons, the contract should be voided and Hankyung should be released from his obligations for SME. Stay tuned to allkpop as the case develops.

F.cuz is the most anticipated group of 2010?

F.Cuz

New group F.cuz is receiving lots of hot attention from netizens even before their debut.

On the 7th, F.cuz opened their official fan cafe and released a number of teaser videos, which were all quite impressive. The videos have received thousands of views on Youtube and on the Korean portal site Naver, there are already 219 videos related to the group.

Kan has been receiving a lot of attention for his good looks and dancing abilities, while Jinon has been coined as the manly leader of the group. Last but not least, the vocal abilities of LeeU and Yejun have sparked an explosive amount of interest in the group.

Netizens have been saying, "They look like they are a group with skills," "Most anticipated group of 2010," "I wish January would come faster as they are debuting then."

F.cuz has been overwhelmed by the amount of attention they are receiving, and have repeatedly expressed their gratitude. Their future looks very promising, and as their debut approaches, we'll soon what they are all about.

Their first digital single will be released on January 8th.

When the scandal regarding Super Junior member Hankyung's request to terminate his contract with SM Entertainment broke out recently, the Korean and Chinese media immediately began scrambling to dig deeper into this issue and read between the lines.

ifeng.com recently held a poll to see how E.L.F members were taking the situation; an overwhelming number of people speculate that this is SME's attempt to create a succès de scandale to raise sales for Super Junior's upcoming concert.

According to the poll, approximately 80% of the fans believed that SM Entertainment had created this controversy in order to hype up Super Junior's upcoming concert in China on January 23, 2010 by conjuring a controversy around Super Junior's single Chinese member. Many don't buy into the coincidence that the tickets went on sale to the public on the 18th, a mere three days before the Hankyung scandal surfaced.

Personally, I have no opinion on the situation yet because there isn't enough information out... but at this point, what's your take on this matter - is Hankyung a victim of a slave contract, a marketing scheme or not a victim at all?

Mir’s Heartfelt Story About His Father

On December 20th, Mir (MBLAQ) shared a very heartfelt and powerful story about his father on his minihompy.

"When I was a sophomore in middle school, my father suddenly quit both smoking and drinking.
Our family was shocked that my father
who began smoking and drinking in middle school quit so suddenly.
I was curious, so I asked him why he quit.
He replied, "I'm old now, so I have to think about my body.."
I did not think much of it and just left it at that.
Then, it was the morning of my field trip in the Autumn semester.
Since morning, I begged my dad for some allowance,
but my dad strangely said that I didn't need any money for a field trip
and packed my fruits and food at home.
At that young, immature age, I was so embarrassed of my father.
That day, my friend came to pick me up,
and he kept bragging that his father gave him a lot of allowance,
so I persistently begged my father for allowance.
However my father never gave me the allowance and kept
packing food in my bag.
I was so embarrassed in front of my friends that I angrily said I didn't need it
and left. Right when I was about to leave, my father took out 5000 won (app. $5) from his pocket and said,
"I couldn't go to Nonghyup (name of a bank) so I couldn't withdraw any money...Have this, at least.."
I thought the allowance was too small, so
I got angry again and didn't take the money and just left the house.
I was so furious that I called my mother and complained.
My mother who was silently listening carefully told me, "Your father's guarantee failed,
so our household is very in a difficult situation..He couldn't even withdraw 100won from Nonghyup,
so he had to borrow money to send you to school."
Only then, I realized the real reason why my dad quit drinking and smoking, why he was not working these days.
Even though I was on a field trip, I ended up crying the entire day.
That was my first as well as my last rebellious childhood.

My father is a very stubborn father.
He always bluntly called me "Ya" "Chul Yong Ah" and "Bang Chul Yong". I probably heard "What do you want to do when you grow up?" the most.
I heard those words throughout school, but they were very stressful to me. On the day I truly became a singer, October 15th, 2009, after the debut stage, I called my father.
"Dad, did you see the debut stage?" I asked, and my father said,
"Yes..We're so proud of our son."
It was the first time he had called me "son", and the first time he told me he was proud of me.
Whenever I am struggling, those words still gives me so much strength
I didn't know it when I was with my father while attending school, but now I miss my father so much."


Wow. What a powerful story.
I think it is time for all of us, sons and daughters of fathers everywhere, to take a few minutes off the internet, and thank our fathers.
I hope Mir will continue to make his father proud!
